Don't Die in 2013: Confiscatory 55% Death Tax Set to Take Effect

Current Law

The 2001 tax relief bill (EGTRRA), drastically reduced the impact of the death tax over the course of a decade, so that it was eliminated entirely for one year in 2010 — a good year to die, joked a number of pundits. The bill lowered marginal rates and increased the applicable exclusion amount, but it also included a provision allowing individuals to carry over exclusion dollars that were unused by their spouse at the time of his or her death. This “portability” measure effectively increased the applicable exclusion for many households, in some instances putting millions of dollars beyond the reach of the federal government.
The death tax rose from the grave at the end of 2010, with a Bush-era top rate of 35% and an applicable exclusion amount of $5 million ($5.12 million in 2012).
Scheduled Changes

In 2013, the death tax will revert to its antiquated, pre-2001 form. The applicable exclusion amount will plummet to $1,000,000, and the top marginal rate will leap twenty points to 55%. A 5% surtax will also return, to be levied on estates between $10 million and $17 million. This raises the top effective rate of the death tax to 60%.
ATRF Analysis
According to research by the Tax Policy Center, if the current death tax expires, then the resulting, stricter exemption threshold will force 114,600 estates to file for the tax in 2013 — this represents a 13-fold increase from the previous year’s 8,800 estates, and countless wasted hours filling out tax paperwork. Of that cohort, an unfortunate 52,500 will be liable for the tax, way up from 3,300.
While those 52,500 taxpayers only represent 2% of those who die each year, no one should be fooled into thinking that the effects of this tax fall only on the proverbial “one percent.” The economic incidence of the death tax is far broader, because it causes many wealthy individuals to save less, choosing instead to retire early or, as Milton Friedman put it, “dissipate their wealth on high living.” This reduction in savings means a concomitant reduction in investment, lessening the flow of capital to businesses and organizations where countless ordinary Americans are employed.
Additionally, use of estate planning lawyers, life insurance trusts, and inter vivos gifting (all common practice in upper-income circles) allows many wealthy individuals to minimize their estate liability, so that the death tax ends up harming only those who could not or chose not to navigate a maze of legal loopholes.
But the ills of a 55% death tax are not just speculative. Prior to 2001, when the death tax stood at 55%, a 1994 study by the Tax Foundation found that a 55% estate tax “has roughly the same effect on entrepreneurial incentives as a doubling of income tax rates.” The same death tax today, then, would have similar decision-distorting economic effects as an 80% income tax on affected parties. A 1992 study that was generally pro-redistribution piled on, finding that the paperwork and compliance costs of the estate tax largely cancelled out any revenue raised from the tax.
This consistent finding — that the death tax is effectively revenue neutral, and is a net economic drain — exposes the class warfare aims of death tax advocates. The other reasons listed merely reinforce the point: that the death tax increase should be vigorously opposed.

Obamacare Hyper-Inflates IRS: The Fourth Branch of Government

More than 200 years ago, enlightened men of a far more superior intellect than anyone in authority today established a framework which is the foundation of all of the American liberties. And for this, precious blood is spilled.

After the monarchy had been expelled, those who had embarked on the struggle for freedom knew that they had to give this brand new nation some strong legs that would carry her far into the future. Those legs comprise the three separate, but equal, branches of government, with the idea being that each branch would keep the others in check. Here is a brief refresher for those who were educated in a government school:

The legislative branch writes the law; the executive branch carries out the law; and the judicial branch interprets the law.
In the last 100 years, we have had men (and women) in all three branches who think THEY are of far more superior intellect than anyone who has existed. But when we listen to the likes of Nancy Pelosi and Harry Reid we might experience the same response as waking up next to a bad mistake.

These glittering jewels of colossal brilliance have overstepped their constitutional authority to such a degree that they have instituted a fourth branch of government: The Internal Revenue Service. Its role is to enforce the will of the ruling class on the people through the tax system.

The IRS, under the name The Bureau of Internal Revenue, first came into being during the Civil War, when a temporary income tax was put in place to fund the war effort. Although post-war monies were needed to fund the continuing Reconstruction, the tax was politically unpopular and Congress allowed it to expire in 1872.

There were various failed attempts to re-impose the income tax, but it was not until 1913 that the 16th amendment, establishing a national income tax, was ratified. This was mainly due to a successful class warfare campaign, put forth by the progressive movement, which convinced people that only the rich would pay the tax. With the income tax in place, it allowed the cancer known as the IRS to firmly take root.

Using a carrot and stick approach, the tax system has been set up so as to allow write-offs and deductions for certain behaviors, and to impose penalties for other behaviors. It is the government’s way of steering the population in the direction they would have us to go. What is worse, the income tax punishes productivity with a higher tax rate, and rewards the lack of it with a tax credit. Common sense would dictate that reward should be reserved for the behaviors we want MORE of, but the ruling class cannot abide a citizenry that is productive and self-sufficient.

Thus, Uncle Sam gifts laziness and sloth as a vote-buying ploy. In fact, half the population pays no income tax, at all.

Now, thanks to the overreach of the executive and legislative branches, and the sanctioning of that overreach by the judicial branch, the IRS has been given enforcement power over our health care. When the government controls your health care, the government controls YOU, and the “brown shirts” at the IRS have been given that task. The department has already begun to hire thousands of new agents to handle the additional workload. The tax code, which has already grown to thousands of pages, has systematically ballooned to thousands more.

According to a report by The Americans for Tax Reform (ATR), the average American in 2012 had to work until July 15, deemed the “Cost of Government Day”, in order to earn “enough gross income to pay his or her share” of the cost of government. This includes federal spending, state and local spending, and regulatory costs. The report also claims that if taxes are allowed to increase, as many in the ruling class are clamoring for, the “Cost of Government Day” could extend beyond August. [1]

Additionally, if you plan to kick off anytime soon, you had better do it this year. ATR also reminds us that the death tax is set to rise in 2013:

So then, how can we consider ourselves a free nation if we spend more time out of the year working to provide for the hogs at the trough than we do to provide for ourselves? Or how can we consider ourselves a free nation if the government now has the authority to mandate a purchase, with the failure to do so resulting in a tax? And how can we consider ourselves a free nation if the government keeps more of our inheritance than we leave to our families? Yet, there is so little public pressure put on the politicians to reform the tax system, partially because people like the emotional high of getting a fat check from Uncle Sam at the beginning of the year. It is one more example of behavioral control through taxation.
The ruling class considers all of the wealth as belonging to them, and THEY will decide how much you are allowed to keep. The IRS has been allowed to grow into such a massive behemoth that it makes Michael Moore look like a famine victim, and the tax system has become such a tangled knot that once the consequences of Obamacare are fully realized, the gears of the economic engine will lock up completely and grind to a halt. This does not account for the amount of debt that our country is already shouldering. Our entire way of life is on the verge of collapsing. Of course, the ruling class is salivating at that very prospect, as they despise the free enterprise system and hold the concept of self-determination in complete disdain.
Fundamental tax reform is as vital to the survival of our republic as national defense. The framework of liberty in America is being allowed to decay. Those three legs that the founders steadied her upon have been turned into four. With the IRS being the fourth leg, added to the three corrupted legs, America has now been made to walk like a dog with a limp by the new monarchy.
The American Revolution was fought over taxation, and , if we want to maintain our freedom, the American Restoration must also be fought over taxation.

A group of concerned Christians are calling on Facebook to remove a page that promotes the notion that the Virgin Mary of the Bible should have received an abortion. Titled “Virgin Mary Should’ve Aborted,” the administrator of the page claims to “explain what really happened in the biblical times, since the bible is full of lies.”

With just over 3,000 ‘Likes,’ Celene Schartner of Australia says the page not only demeans what Christians believe, but it is slanderous and hateful. It diminishes the right to life of every unborn infant in its mother’s womb by its very title and statement.

Ramadan Death Toll: Sunday 04/08/13

(Algeria) The Algerian army killed three Tunisian terrorists in the northeast part of the country near the border with Tunisia. On July 25, eight Tunisian soldiers were killed by militants in mountain Chaambi. Since then, the Tunisian and Algerian armies have launched a wide scale operation to track down the perpetrators.

(Tunisia) Tunisian police shot dead an Islamist terrorist in Tunis and a soldier was killed in a blast near the Algerian border on Sunday, as the government grapples with the growing security and political crises in the country.

(Pakistan) Terrorists murdered a former district chairman and his son (Muhammad Sharif and Muhammad Younus) as they walked home.

In the city of Karachi, 2 more bodies were found Sunday, a result of the latest bout of killings which has beset the city.

(Syria) In fighting between the rebels and the army inside Syria 30 people were killed in the Jabal Akrad mountains on Sunday.

A Syrian man was killed Sunday by Syrian army forces while trying to cross the Grand River separating Lebanon from Syria.

Unidentified gunmen stormed a Damascus home and killed five members of a family that supports the regime of President Bashar Al Assad. "Five members of one pro-regime family — a man, his wife and their three daughters — were killed (on Saturday) by unidentified gunmen in the district of Rukn Al Din” in northern Damascus, said the Syrian Observatory for Human Rights."

9 people were liked during an airstrike by the Syrian Airforce in the town of Yabroud.

(Iraq) 15 people were killed around Iraq on Sunday in what seems was a very quiet day in the beleaguered country. The deadliest attack took place late Sunday night when gunmen in a speeding car opened fire randomly on a gathering of people on a street in the city of Kirkuk, killing four people and wounding three. A bomb later exploded inside a cafe in western Baghdad shortly before midnight, killing three and wounding 12. Earlier in the day, a roadside bomb struck an army patrol near the northern city of Mosul, killing three soldiers. In Tikrit, in central Iraq, a car bomb killed Judge Sajid Abdul-Amir as he was driving to his work. In eastern Baghdad, two people were killed in a blast, police said. Meanwhile, mortar rounds landed on houses in the capital's western suburbs, killing two people.

(Lebanon) An explosion that took place in a house in Daraya town, Mount Lebanon, Sunday killed an Egyptian citizen, and seriously injured his brother. Lebanese army forces rushed to the scene soon after the explosion and found explosives and walkie talkies in the house. The forces also cordoned off the hospital where the two wounded were treated, as well as arresting two Egyptians living in the house.

(Yemen) Lieutenant Colonel Mohammed el-Mamari was shot dead on his way home on Sunday. He was walking to his car after work when two unidentified gunmen killed him in the central province of Bayda.

Peace Prize President Prepares For All-Out Drone Assaults

On Monday, President Barack Obama announced that he nominated John Brennan to head the Central Intelligence Agency.

So far, 2013 has been a busy year for Nobel Peace Prize-winning President Barack Obama, as his Administration launched six drone strikes in Pakistan during the first eight days of the year. The strikes have been blamed for an estimated 35 deaths.
According to reports, the United States launched 43 drone strikes in Pakistan last year, less than half of the number of strikes during the most aggressive bombardment of the nation in 2010. But the frequency of drone strikes in the initial days of 2013 and other indicators likely offer telltale signs that the drone war will ratchet up again.
On Monday, Obama nominated counterterrorism adviser and drone murder aficionado John Brennan to head the Central Intelligence Agency, which has taken a primary role in drone assaults in recent years.
While the number of civilian deaths that have occurred from drone warfare is widely disputed (some international agencies have estimated the civilian death toll to be anywhere between 5 percent and 20 percent of all drone-related deaths in Pakistan), Brennan has publicly supported expanded drone warfare. According to The New York Times, Brennan even claimed in 2011 that for more than a year there wasn’t “a single collateral death because of the exceptional proficiency, precision of the capabilities we’ve been able to develop.”
Because the CIA is the primary operator of America’s deadly drone program, there are no concrete, publicly available numbers related to civilian death tolls from drone strikes. But Brennan critics say his earlier assertions are ridiculous, and the Bureau of Investigative Journalism estimated the number to be near 500 civilian casualties late last year.
Another caveat of the policy of constantly pummeling tribal Pakistan with drones is the psychological impact it is having on the non-militant population of the region. People terrified of the American death machines in the skies are more easily co-opted into anti-Western extremist groups.
