USDA Admits Exterminating Birds, Crops, and Bees

The USDA has been under fire recently for its admitted assault against nature, after multiple investigations have uncovered its deliberate tampering with both plants and animals alike. One such investigation has put an end to the mystery surrounding the death of millions of birds, with USDA documents revealing the organization’s role in the massive slaughter. In addition to the mass bird killings, it turns out the USDA was fully aware that a highly-popular herbicide chemical was a known bee-killer, which may have aided the bee decline. The USDA has also threatened the genetic integrity of the nation’s crops. Information has surfaced regarding the USDA’s illegal approval of Monsanto’s biotech crop, sugar beets. These crimes are simply an excerpt from the long list of USDA crimes that are continually being exposed.

In December of 2010, mystery struck the world. Reports of mass fish and bird die-offs were coming in from Texas to Sweden. The first occurrence in the series of strange events started in Arkansas, where 3,000 birds fell from the sky. In the following days and weeks, similar incidents were reported with no solid explanation. The reason has now been found, thanks to documents found on the USDA’s website. Claiming to be protecting farmers from predators, the birds were victims of a little-known government program. Like millions of other animals since the Bye Bye Blackbird program was created in the 1960?s, the birds were poisoned and killed for being considered a nuisance to farmers. It is important to take note that many of these animals don’t pose any immediate threat to farmers. 

 

In the 1960?s the USDA established a program referred to as the Bye Bye Blackbird program. This program is solely responsible for the mass killings of what could ultimately be millions of birds across the nation. In 2009 alone the USDA poisoned and killed over 4 million birds. The documents state whether or not the deaths were intentional or unintentional on the government website. You can find extremely large numbers, such as 22,276 blackbirds marked as intentionally euthanized. Here is some data from the USDA itself: 

Brown-headed cowbirds: 1,046,109

European Starlings: 1,259,714

Red-winged blackbirds: 965,889 

Canadian Geese : 24,519

Pigeons: 96,297

Grackles: 93,210

Starlings European: 1,259,714 

These numbers are simply the top for 2009. Let us not forget about all the other years animals have been killed since the 1960?s when the program was first created.

According to Natural News :

A Nebraska farmer was apparently complaining that the starlings were defecating in his feed meal. The answer to this conundrum apparently isn’t to cover your feed meal but rather call the USDA and ask them to poison thousands of birds. The USDA complied, apparently agreeing this was a brilliant idea. So they put out a poison called DRC-1339 and allowed thousands of birds to feed on that poison.

“Cows are supposed to eat grass. If you are running a cow operation where the birds are eating your grain and you think the birds are the problem, the real problem is that you’re feeding cows the wrong food! If you raise your cows on grass, the birds don’t get into the grain and you don’t have to poison the birds.

“You see, when one ecological element gets out of balance (feeding grain to cows, for example), it then causes another problem that must be dealt with in some other destructive way (such as poisoning the birds). This cycle of disharmony continues and escalates until entire ecosystems are out of whack. Then the USDA shows up with a pickup truck full of poison bait and goes to work poisoning animals. The solution isn’t to keep poisoning animals and trying to control populations through toxic chemicals but rather to return to holistic web-of-life farming methods that work in harmony with nature rather than treating nature as the enemy."

The government is committing what many people would call a crime. Killing mass amounts of animals via poison is a flagrant act of violence against nature that should not be tolerated or encouraged. People aren’t allowed to hunt in certain regions of the United States, but the government is allowed to kill off animals by the millions. Something is terribly wrong with this picture.

 In recent years the world honey bee population has plummeted in North America. This is important because bee pollination is crucial for the fertilization of many crops. Just as many potential explanations arose over the mysterious bird deaths, many different theories have been proposed to explain the bee decline. Electromagnetic radiation, malnutrition, and climate have all taken the heat of critics looking for answers. Recently, however, a document was leaked revealing that a bee-killing pesticide put in use by the EPA may be to blame. Adding to the controversy, more records have emerged showing that the USDA was fully aware of the pesticide's threat to not only bees, but humans. The two-month-old report released by the USDA itself unveiled that the toxic insecticide used on plants are not only a threat to insects’ central nervous systems, but are also a threat to the internal systems of humans.

Imidacloprid, one of the neonicotinoid family of pesticides introduced over the past 15 years, is likely to be responsible for Colony Collapse Disorder (CCD), the recently observed phenomenon in which bees abandon their hives en masse, according to the study by scientists from the Harvard School of Public Health in the United States.

The study, to appear in the June issue of The Bulletin of Insectology, provides "convincing evidence" of the link between imidacloprid and CCD, claim the authors, led by Alex Lu, associate professor of environmental exposure biology in the school's Department of Environmental Health. It follows two other widely publicised studies, from Britain and France, published last week in the journal Science, which strongly suggested that neonicotinoids were linked to the declines in bees and other pollinating insects seen in Europe and the US.

Neonicotinoids, which attack the central nervous system of insects, are considered by some scientists as dangerous to species which are not the compounds' principal targets, because they are "systemic" – meaning they do not just sit on the surface of a plant but are taken up into every part of it, including the pollen and nectar, where they can be ingested repeatedly by bees and other pollinating insects.

Twice in the past three years, the Government has been asked, on the basis of compelling evidence, to suspend the use of the new generation of neonicotinoid pesticides, until the increasingly worrying evidence that they are extremely harmful to bees and other pollinating insects has been shown to be unfounded.

The first occasion was in 2009, by a coalition of environmental groups led by Buglife, the invertebrate conservation charity; the second was in 2011 by the Labour MP Martin Caton, after  paper's disclosure that America's leading bee scientist had found a harmful link. On each occasion the request was ignored by the Department for Environment, Food and Rural Affairs.

Sugar Beets created by corporate giant Monsanto Company, who is leading the genetically modified food market, make up for about half of the nation's sugar supply. The approval of these beets was initially made in 2005, granting Monsanto the right to plant genetically modified sugar beets that could withstand sprayings of the herbicide marketed as Roundup. The entity responsible for the approval? The USDA. Unfortunately, the USDA hadn’t conducted a thorough review of the biotech crop, making the approval flagrantly illegal. To make matters more complicated, the USDA issued permits which allowed companies to plant seedlings that would later produce seed for future sugar beet crops. Judge White, the federal judge who deemed the approval illegal, issued that the seedlings be removed immediately. The immunity that the sugar beets possess against the herbicide being used on them is not exhibited by any other plant, or even humans. With excessive herbicide use comes more poisoned organisms consuming the sugar beets and thus becoming sickly. Additionally, conventional and organic crops are subject to contamination from an overflow of pesticides.

If you thought Monsanto’s lack of testing on their current GMO crops was bad before, prepare to now be blown away by the latest statement by the USDA. Despite links to organ damage and mutated insects, the USDA says that it is changing the rules so that genetically modified seed companies like Monsanto will get ‘speedier regulatory reviews. With the faster reviews, there will be even less time spent on evaluating the potential dangers. Why? Because Monsanto is losing sales with longer approval terms.

The changes were expected to take full effect in March when they’re published in the Federal Register. The USDA’s goal is to cut the approval time for GMO crops in half in order to speedily implement them into the global food supply. The current USDA process takes longer than they would like due to ‘public interest, legal challenges, and the challenges associated with the advent of national organic food standards‘ says USDA deputy administrator Michael Gregoire.

This is just a small fragment taken from a list of . The USDA seems to be recklessly endangering life on this planet with its disregard for what it was created to protect. The reports and documents revealed in this article may very well be the tip of the iceberg. The recently-released document unveiling the bee decline is two years old, and is most likely not the last to be uncovered. It is only a matter of time before more secretive documents come out highlighting the USDA’s shameless lack of respect for life. The USDA has not been forced to openly admit to these claims due to a lack of mainstream media attention. It took investigative journalism to discover these documents and it will take future investigation to oust even more of the USDA’s corruption.

 Print This Post An Islamic news portal has reported on a lecture by former Islamic Society of North America (ISNA) President Ingrid Mattson in which she suggests that Canadian Muslims should base their identity on Canadian “First Nations” people. According to the report, Ms. Mattson bases this view on the relationship between the injustices experienced by African-Americans and those she believed suffered by U.S. Muslims:

In her lecture, she said that the demographic makeup of the American Muslim community has influenced how Muslims there understand their identity.  ‘The reason why I think American Muslims have been able to extract themselves a little bit from simply making American Islam into an anti-Western discourse is for one simple reason and that is approximately 25 percent of the American Muslim community is African American,’ Dr. Mattson told the audience. ‘The priorities of African Americans, in terms of justice, and seeking justice and identifying what is not just, are different than immigrants.’ ‘African Americans are looking at their lives in terms of the structural injustices within the United States, as Americans, and they see an economic system, a legal system that has resulted in the highest incarcerated population in the world, in terms of percentages, and that African Americans are incarcerated in far greater numbers,’ she added. ’They see all around them, not only their history of repression within the United States, but also current legislation and practices.’ She opined that the African American Muslims have pushed the Muslim community to question their understanding of justice. ‘So they were the ones that turned the question around to their immigrant brothers and sisters and said wait a minute – you talk about injustice but ignore the injustices being done to us; you talk about injustice yet you ignore the fact that there are people in your own community who are contributing and participating in systems that oppress us, who are participating in economic systems in the inner-city that take advantage of poor African Americans.’ Dr. Mattson went on to tell the audience that this interaction between African American Muslims and immigrant Muslims has resulted in the discourse moving beyond identity politics to ethics. ‘So I think for American Muslims, African Americans really elevated the issue of justice and generalized it and made it a universal principle and brought it out of simply identity politics – the West versus Islam,’ she said ‘They made us look more deeply at systematic injustice and understand that justice is not about identity but it is about ethics that we should carry wherever we were and we needed to start prioritizing our issues differently.’ She then proposed that, for the Canadian Muslim community, First Nations people can be the challenging conscience for Canadian Muslims as African Americans were for U.S. Muslims.

Ingrid Mattson was elected as President of the Islamic Society of North America (ISNA) in 2006 after long service as an ISNA functionary including as ISNA Vice-President. She is also the director of the Director of the Macdonald Center for the Study of Islam and Christian-Muslim Relations which appears to be developing growing ties with the International Institute of Islamic Thought (IIIT), another important part of the US Muslim Brotherhood and one of the funders of the Huron chair. U.S. media is reporting that Congressman Keith Ellison make the first visit to Somalia in many years by a member of Congress. According to an AP report:

Feb 19, 2013  MOGADISHU, Somalia (AP) — A U.S. congressman visited Somalia’s capital on Tuesday, the first visit in years by a member of Congress to what until recently was considered one of the world’s most dangerous cities. Keith Ellison, a Democrat from Minnesota, said his visit to Mogadishu fulfilled a request from his constituents with ties to Somalia. Minnesota has one of the largest populations of Somali-Americans in the U.S. Ellison, the first Muslim elected to Congress, noted that the U.S. government in mid-January recognized the Somali government for the first time since the country fell into anarchy in 1991. ‘We’ve seen 20 years of warlordism, 20 years of terrorism, of refugees streaming across the border into every neighboring country, piracy in the gulf,’ Ellison told The Associated Press in a phone interview from neighboring Kenya. ‘But a stable Somalia will bring this all to an end, and I think we need to be a part of the solution. I’m telling you, investing money in Somalia is sending good money after good. We should now see Somalia as a trading partner and a partner of educational exchanges.’ Ellison was greeted by Somali President Hassan Sheikh Mohamud. The president said that Ellison’s visit was a big day for Somalia. Mogadishu has experienced about 18 months of relative peace, after the August 2011 ouster of the Islamic extremists of al-Shabab from the capital by African Union forces. Following the advice of security advisers, Ellison did not travel beyond Mogadishu’s airport complex, the most secure part of the city, but he said he wished he had been able to and hopes to on a future trip. He said he never felt in any danger. One of the issues Ellison met with Somali officials about was the financial remittances often sent by Somalis in the U.S. back to family members in Somalia.

Ellison is the first Muslim-American to be elected to Congress. Previous posts have discussed the controversy over his trip to Mecca which was funded by the Muslim American Society, a well-known U.S. Muslim Brotherhood group close to the Egyptian organization.
A post from January reported that the Islamic Society of North America (ISNA) had recently hosted the newly elected President of Somalia in a meeting that included U.S. government officials, notably Rashad Hussain the U.S. Envoy to the OIC, and a representative of the Islamic Circle of North America (ICNA), both Islamic organizations being part of the U.S. Muslim Brotherhood. A post from last September reported that international leaders were calling the election of Hassan Sheikh Mohamud “a great step forward” for Somalia. The BBC report  that was the subject of the September post described Mr. Mohamud, 56, as

…a civic activist who founded a university in Mogadishu and has worked for several national and international peace and development organizations. He has links to al-Islah, Somalia’s branch of the Muslim Brotherhood.’

A 2007 article on the  Egyptian Muslim Brotherhood  website confirms that Al-Islah is, in fact, the Somali branch of the Global Muslim Brotherhood. A Somali web portal recently described Al-Islah as follows:

Al-Islah, the internationally-recognized MB outfit, can best be described as a small organization with an elitist bent. Many of the rank- and- file members are educated and have no commonality with the average Guled or Maryam. Whereas the Egyptian MB shares the same elitist quality with its brethren in Somalia, it was nevertheless able to articulate its political and social agendas with the Egyptian masses. Al-Islah, on the other hand, has generally steered of being part of Somalia’s political process because it lacked vision, grass-roots support among the masses, and a willingness to cooperate with other–and in some cases bigger– Islamic movements in the country. For the last two decades, al-Islah has distinguished itself by telling the international community that it is not Salafi, and hence militant. The leadership has failed to define its movement other than reciting that it is not Al-Ittihad al-Islami (AIAI) or al-Shabab.

Washington Backs Syrian Anti-Government Terrorism

February 24, 2013 "Information Clearing House" - Make no mistake. Syria is Washington's war. It was planned years ago. Regime change is policy. At issue is replacing Assad's government with a pro-Western puppet one.

 

Washington tolerates no independent governments. It demands subservience to US policies. Outliers are targeted for removal. Options include war. 

 

Mass slaughter and destruction don't matter. Unchallenged dominance is policy. It's longstanding, ruthless and lawless.

 

Western-recruited death squads ravage Syria. They've done so for two years. They're imported from abroad. Rules of engagement include mass murder, torture, and other atrocities. 

 

Pro-Assad loyalists are prime targets. Innocent civilians are massacred. Doing so is official US policy. Imperial wars are called liberating ones. Terrorism is what they do, not us.

 

Syria was peaceful before US proxies invaded. So was Libya in 2011. It was ravaged and destroyed. It remains unstable and violent. Libya 2.0 looms. 

 

Syria may become NATO's latest charnel house. It's well along the way already. Countries are ravaged on the pretext of liberating them. Empires never say they're sorry. Policy isn't pretty. It's violent and lawless. 

 

It reflects state terrorism. It proliferates death and destruction. It prioritizes wealth, power, privilege and dominance. Direct and proxy wars are waged. 

 

Cutthroat killers are used. They're recruited abroad. They're heavily armed, trained, funded and directed. They're ordered to commit mass murder. Obama bears full responsibility. He's a war criminal multiple times over.

 

On February 22, the Syrian Arab News Agency (SANA) headlined "Fifty-Three Civilians Martyred, 235 Others Injured so far in Terrorist Bombing in al-Thawra Street in Damascus."

 

Attacks struck central Damascus' Mazraa neighborhood. Health Minister, Dr. Saad al-Nayef, said "terrorist bombing reflects the criminal nature of its perpetrators."

 

Innocent men, women, children, the elderly and infirm were massacred. Syria continues to be ravaged and destabilized.

 

Al-Hayat Hospital and Abdullah Bin al-Zubir school were heavily damaged. So was Russia's embassy. Itar Tass quoted a diplomat saying "The building has really been damaged. The windows are shattered."

 

Other car bombs struck Damascus' Barzeh neighborhood. A police station, telecommunications facility, and drug enforcement agency were targeted. 

 

Mortar fire hit Syria's Army General staff headquarters, Tishreen Sports City and residential buildings. Authorities said a car loaded with tons of explosives was stopped before it exploded.

 

Perhaps the terrorist group Jabhat al-Nusra was involved. It's become Washington's lead belligerent. It vows to "liberate" Damascus. It claims responsibility for 17 or more February Damascus area terrorist attacks. They included at least seven bombings.

 

Syrian communities abroad, Russia, China, Iran and Hezbollah condemned Thursday's bombings. 

 

Russian Foreign Ministry spokesman Alexander Lukashevich said:

 

"Once again, we call upon all countries and parties, which might influence the extremists and radicals, to pressure them and demand immediate stop of such terrorist acts and armed violence in order to create appropriate atmosphere to hold a Syrian dialogue that is based on Geneva statement issued last June, 2010."

 

UN Secretary-General Ban Ki-moon showed which side he supports. He's an imperial tool. He shames the office he holds. He violates UN Charter provisions. He urged both sides to show restraint. He called for ending Syria's crisis politically.

 

Syria's Foreign and Expatriates Ministry addressed two identical letters to the Security Council president and Ban. They condemned Thursday's bombings. They called them cowardly acts.

 

They targeted crowded civilian areas. They followed previous ones conducted by Al Qaeda linked groups. They get "financial and logistic support and media and political coverage from regional and (Western) countries."

 

SANA said:

 

"The Ministry added that the credibility of combating terrorism which has always been a matter of concern for the international community is now under unprecedented test as the most disgusting form of terrorism hit the Syrian civilians with no mercy or differentiating between an elderly man or a child."

 

"The letters added that Syria, in its previous letters to the UN Security Council and the UN Secretary General, called for firm and clear condemnation of these heinous terrorist crimes by the UN member states and for holding countries which support such acts as responsible, whatsoever the form of such support was."

 

"The Ministry said that Syria hopes the UN Security Council now will be able to adopt a firm stance which proves its commitment to combating terrorism regardless of its timing or place."

 

If the Security Council turns a blind eye, "it will deepen doubts in its seriousness in combating terrorism and its commitment to implementing its resolutions in this regard, in addition to the fact this will be considered as a kind of political concealment of these crimes."

 

The international community's credibility "is at test," it added. Failure to condemn this type terrorism is morally unconscionable. 

 

It provides evidence of Western double standard duplicity. It reflects  support for "organized terrorism." Doing so won't deter government forces from defending its citizens. Assad is committed to do so.

 

On February 21, Washington vetoed a Russian draft statement. It condemned Wednesday's terrorist attacks. Moscow denounced US policy. It reflects support for what demands condemnation.

 

Foreign Minister Sergey Lavrov left no doubt where Russia stands, saying:

 

"This opposition by our American partners....is not the first time in which they seek a form that justifies those who fight the Syrian regime."

 

"Russia sees in the American position an application of double standards and a dangerous approach in terms of the Americans moving away from the main principle of condemning terrorism in all its forms."

 

 

Russia's UN mission issued a statement saying:

 

"It is obvious that by doing so, the US delegation encourages those who have been repeatedly targeting American interests, including US diplomatic missions."

 

It's not the first time Washington obstructed responsible policy, it added. Moscow called doing so unacceptable. It reflects support for mass murder. It's official US policy.

 

It threatens Lebanon. Free Syrian Army General Selim Idriss accused Hezbollah of shelling villages around Qusayr in Homs Governorate.

 

He issued an ultimatum. He threatened to respond if attacks don't stop in 48 hours. He accused Hezbollah of sending combatants to Syria.

 

"As soon as the ultimatum ends," he added, "we will start responding to the sources of fire."

 

Hezbollah's Hassan Nasrallah categorically denies sending fighters to Syria. At the same time, he said party members may be acting individually. He added that around 30,000 Shitte Lebanese inhabit 22 Syrian villages. Volunteers defend them against terrorist attacks.

 

On February 21, Lebanon's Daily Star headlined "FSA claim of strikes on Lebanon false."

 

An FSA statement claimed otherwise. It said one of its battalions targeted two Hezbollah bases. It struck with mortars, "machine guns and anti-tank missiles." It did so near the Syrian/Lebanon border. It vowed more "surprises" ahead. 

 

Longstanding Washington/Israeli policy prioritizes destabilizing Lebanon. At issue is replacing Hezbollah with pro-Western puppets, toppling Assad, isolating Iran, and solidifying US regional control.

 

Lebanon is small and vulnerable. From 1975 - 1989, it was wracked by internal conflict. From 1982 - 2000, Israel occupied southern Lebanon.

 

Hezbollah arose out of Israel's 1982 invasion. It's falsely called a terrorist organization. It's for political reasons. It's part of Lebanon's government. It's also a social, charitable, educational, and medical organization.

 

It provides essential social services. It's military wing is defensive. It threatens no one. It's prepared to respond forcefully if attacked. Israel learned the hard way in 2006. Its forces were outfoxed and humiliated. Israel yearns for revenge.

 

Involving Lebanon in Syria's war may be planned. Obama and Netanyahu may have that in mind.

 

On February 21, Mossad-connected DEBKAfile (DF) headlined "Hizbollah on high alert, jockeys for a role in potential Syrian peace accord," saying:

 

Its forces went on alert after the FSA's ultimatum expired. Will its Beqaa Valley serve Assad, DF asked? Will its forces get involved? Are ceasefire talks credible?

 

According to DF, Assad's military largely controls most of Syria. Ties to Hezbollah and Iran are firm. Each ally helps the others.

 

At the same time, FSA fighters may escalate conflict. They may conduct cross-border attacks. They're no match for Hezbollah's "far more organized and professional capabilities."

 

"If they decide to go on the offensive, they are liable to suffer heavy losses." Of greater concern is widening Syria's conflict. 

 

Israel's currently involved. Last fall, IDF tanks shelled Syrian mortar batteries. Washington OK'd Israeli air strikes. Several targets were struck.

 

Israeli warplanes invade Lebanese airspace multiple times daily. They do so without permission. Policy is longstanding. It violates international law. Perhaps escalated conflict is planned.

 

It shouldn't surprise. Washington and Israel partner in imperial lawlessness. Syria, Hezbollah, Hamas, and Iran are prime targets. Regional conflict may follow. What's possible bears watching. Future updates will discuss more.

In December 2011's "US Caught Meddling in Russian Elections,"US National Endowment for Democracy (NED) funded GOLOS was noted as being the key "observer" cited across Western media in an attempt to portray the Russian elections as "stolen." GOLOS owes its existence to the US government and in turn the banking oligarchs of Wall Street and London who have been trying in vain to dislodge Russia's Vladimir Putin from power for years. Kramer in his piece would cite this gaggle of US-funded NGOs and the opposition parties they support as a "clear indicator of the desire for change." Kramer even shamelessly mentions GOLOS by name, claiming they are "the sole independent Russian election-monitoring organization" despite the fact that they are clearly not independent, being funded proxies of the US State Department. Apparently pointing this out, Kramer argues, is defined as a "smear campaign." Kramer then goes on to cite his own organization's dubious, politically motivated work as evidence against how "undemocratic" Russia is before concluding that "evidence of rigging" will lead to a rejection of the results and justification for instability similar to what was seen across the US-manufactured "Arab Spring." It should be noted that Freedom House was cited by even the New York Times as being a sponsor of the "Arab Spring" unrest. And when considering such "evidence of rigging," already, Russian authorities are investigating claims of faked-vote rigging videos, the type used by US-funded GOLOS in conjunction with the Western media to incite unrest in Russia last December. With FP's article, we see that the Western media has already determined how Russia's elections will unfold, creating the pretext in the minds of impressionable viewers to justify the unrest the US is undoubtedly planning. It is important to keep in mind Freedom House president David Kramer's words, knowing that both the National Endowment for Democracy and Freedom House are self-serving frauds, when listening to these very same talking points regurgitated by the Western media during the elections this coming Sunday. US Media Rigged Ahead of Russian Elections

Rigged media already crying foul over elections yet to take place.

In the spirit of recognizing mobs of terrorists as legitimate national governments before a sovereign nation's true leadership is murdered by US-led NATO operations, as was the case in Libya, the Western media is already decrying Russia's upcoming elections as "rigged" before they've even taken place. Leading the preemptive media coverage is Foreign Policy (FP) magazine featuring an article by Freedom House president, David Kramer, and Freedom House vice president, Christopher Walker.

The FP piece titled, "The Kremlin's Big Gamble: Can Vladimir Putin's simulated democracy survive another rigged election?" in title alone already implies that the elections, which polls have long indicated Putin is overwhelmingly expected to win, will be "rigged." This in and of itself is "rigged" coverage -- reporting conclusions to events that have yet to unfold.

Jury Nullification Activist Jailed 145 Days for Distributing Info

Army Vietnam Veteran, peaceful freedom activist, and local small businessman, Mark Schimdter, has been jailed for 145 days by Judge Belvin Perry. Schmidter's sentence began Thursday after he was found guilty for distributing jury nullification info outside of Perry's self-imposed "free speech zone." during the Casey Anthony trial.

Mark E. Schmidter is an activist for jury rights whose story we covered one year ago. He was originally facing a year in jail after being found guilty of two felonies: External Criminal Contempt of Court, and jury tampering, for distributing information outside the Orange County Courthouse in Florida.

We noted that Schmidter was not guilty of any actual law, but rather rules written by the acting judge. These rules that Schmidter is in violation of are for demonstrating outside of a "free speech zone" determined by Judge Perry. Schmidter, who was first arrested in June 2011, has maintained his innocence and that the judge's orders he violated were a direct violation of the First Amendment of the Constitution.

Furthermore, the very rule he was found to be in violation of has been overturned.

Judge Belvin Perry issued Administrative Order # 2011 03 which states that if anyone hands out information, talks or hold a sign outside the courthouse, they would be held in contempt of court and jury tampering.

Administrative Order #2011 07 states that anything that has to do with “Free Speech” may only be done in the free speech zones which are two 10’x30’ remote areas nearly a football field away from the courthouse doors. It is the same rule that was used to jail another jury nullification activist, Julian Heicklen.

Here is Schmidter being interviewed before his court appearance in June, 2011:



Although violating these orders is a misdemeanor offense, Schmidter was charged and convicted of two felony counts. Because of the felony charges, and suspecting that he couldn't get fair treatment from the judge who wrote the Administrative Orders, Schmidter requested a trial by peers and for Judge Perry to recuse himself from the case. He was denied on both requests. Schmidter has referred to Judge Perry as the "lawmaker, prosecutor, judge, jury, and executioner."

After serving four days in jail, Schmidter was released on bail and appealed his case. As WFTV Orlando reported:

Chief Judge Belvin Perry designated a special area for public protesting, and he held Mark Schmidter in contempt because Schmidter didn't use the designated area. 

In December, an appeals court shot down the designated area but agreed court protesters could not distribute things outside court. 

Schmidter's lawyer plans to challenge Thursday's re-sentencing. (Source)

Mr. Schmidter is a purely peaceful activist who believes in the historically well established rights of juries to judge the law as well as the facts and also that if there is no victim, there is no crime and jurors may agree. If a 64 y/o Vietnam veteran can be thrown in jail for passing out leaflets with an opinion that is different than the status quo, then, We are All Mark Schmidter. 

The most recent confinement occurred per an arbitrary rule a man wrote, judged, denied jury for, sentenced under, was since found illegal by a higher court and even repealed himself due to that order.

This begs the question, since that rule has been found illegal, who is the real criminal under their actions today?
