This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. This solicitation N40192-13-Q-7034 is being issued as a Request for Quotation (RFQ). All solicitation documents and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-66. This procurement is a 100% Small Business set-aside IAW FAR 19.502-2 (a). The NAICS code is 541620 and the small business size standard is $14 Million. The contractor shall provide following commercial services requested in this solicitation:

PERFORMANCE WORK STATEMENT (PWS) FOR PREPARATION OF EMERGENCY PLANNING COMMUNITY RIGHT-TO-KNOW ACT (EPCRA) REPORT

1. OVERVIEW:

1.1 Conduct a detailed review of information specific to the Territory of Guam and Andersen Air Force Base (AAFB) necessary to complete the 2012 Toxic Release Inventory (TRI) Report. A Tier II report will also be generated using the US EPA computer software for the 2012 reporting year.

1.2 Andersen Air Force Base is a strategically located forward main operating base. The 36th Wing of the Pacific Air Forces is host unit to USAF Active, Reserve, National Guard, US Naval Forces and a variety of tenant units. Fully integrated, the base and units of Team Andersen provide the Commander, US Pacific Command extraordinary operational flexibility in the Western Pacific and East Asia. The base is postured to support operations across the spectrum of conflict to include sustained combat operations.

1.3 Various units purchase hazardous materials through the Hazmart Pharmacy which is under Logistics Readiness Squadron (36 LRS). Other units and tenant organizations may have their own sources of supply. These units may include but are not limited to Army and Air Force Exchange (AAFES), 36 Medical Group, 734 Air Mobility Squadron, Helicopter Sea Combat Support Squadron Twenty-Five (HSC-25) and Bulk Fuels Storage.

1.4 The TRI is a publicly available EPA database that contains information on toxic chemical releases and other waste management activities reported annually by certain covered industry groups as well as federal facilities. Tier II reports provide state and local officials and the public with specific information on certain chemicals that are present at facilities during the previous calendar year. Under Section 313 EPCRA of 1986 and expanded by the Pollution Prevention Act of 1990, AAFB is required to submit the annual report to the United States Environmental Protection Agency (USEPA).

2. DESCRIPTION OF SERVICES:

2.1 The Contractor shall provide a full range of service to develop and prepare TRI and Tier II reports. The Contractor shall furnish all personnel, equipment, materials, supervision and other items and/or services as necessary for providing the services listed for AAFB.

2.2 The Contractor will be expected to travel to Guam and perform data collection on base for the 2012 reports and for each option year thereafter. The Contractor shall conduct a physical audit of all units and associated facilities to include units with their own sources of supply that could potentially use Tier II or US EPA Form R reportable agents. The Contractor will also evaluate the Explosive Ordnance Disposal (EOD) element and 36th Security Forces Squadron (36 SFS) firing range to determine if a separate submittal is required and to include information as appropriate for EPCRA reporting.

2.3 The Contractor will be expected to obtain the necessary Material Safety Data Sheets (MSDS) from the units or product manufacturers. The Contractor may also utilize information obtained from the Base Hazmart Pharmacy's installation approved database or any other appropriate source. The contractor is required to obtain additional information from manufacturers or other scientific resources and determine the threshold for the Persistent Bio-accumulative Toxic (PBT) chemicals. The Contractor shall coordinate with individual units to ensure the accuracy of the data obtained for the purpose of the report.

2.4 The Contractor shall provide AAFB with a thorough synopsis detailing the rationale used in preparation of US EPA Form R and Tier II reports at the time of report submission. The rationale shall include all supporting backup information and calculations forming the basis for listing or not listing an item or chemical component.

2.5 The Contractor shall work with the AAFB Environmental Management System (EMS) Director, Guam EPA, as well as any other agencies, to ensure the Tier II is submitted in the format(s) required.

2.6 The Contractor will prepare a draft Tier II report using the Tier2 computer software developed by EPA and National Oceanic and Atmospheric Administration (NOAA). Submit software for the 2012 reporting year. Based upon comments received on the draft report, the final Tier II report will be prepared using the most current version of the USEPA reporting software.

2.7 The Contractor will create a draft TRI report using EPA-260-B-06-001 (Toxic Chemical Release Inventory Reporting Forms and Instructions, 2006 or most recent version) and the Report Year (RY) 2012 Toxic Release Inventory - Made Easy (TRI-ME) software. Based upon regulatory comments, the final TRI report will be generated using the USEPA software.

2.8 AAFB will need a minimum of 2 working days to review each Tier II and TRI draft reports. In addition to submitting the report information using the appropriate USEPA software, AAFB will be provided with one each final hard copy report that reflects the report information submitted to USEPA and other agencies as required.

2.9 In the completion of these tasks, the Contractor shall comply with all federal and local rules and regulations. A security clearance is not required, but ability to gain temporary access to the installation is required. Base access will generally be from 0700 to 1630.

2.10 The first report Tier II (Emergency & Hazardous Chemical Inventory is due 1 March of each reporting year. The second report, "Toxic Release Inventory" (TRI) is due 1 July of each reporting year.

2.11 Travel expenses are the responsibility of the Contractor. It will be the responsibility of the Contractor to pay for standard air fare, hotel, food, automobile, gas, and all other costs associated with traveling.

3. GENERAL INFORMATION.

3.1. GOVERNMENTAL REMEDIES. The Contracting Officer shall follow the requirements of FAR 52.212.4, Contract Terms and Conditions for Commercial Items (May 1997), for contractor's failure to correct nonconforming services.

3.2. GOVERNMENT HOLIDAYS. The following is a list of U.S. Government holidays. No work will be performed on U.S. Holidays. If the holiday falls on a Saturday, the preceding Friday is observed as the holiday, if the holiday falls on a Sunday, the following Monday is observed as the holiday.

3.3. HOURS OF OPERATION. Duty days and duty hours will be Mondays through Fridays, 0700-1630 hours except recognized U.S Government holidays.

3.4. SECURITY REQUIREMENTS. The Contractor is responsible for obtaining all necessary documentation for base entry. Coordination for personnel and vehicle passes shall be accomplished through the 36th Security Forces Squadron Law Enforcement element. All contractor employees shall undergo a criminal history background check from the local law enforcement's office as appropriate. Only employees with a favorable background check results will be allowed entry to Andersen Air Force Base. The Contractor will be responsible for safeguarding all Government property provided for Contractor use. At the end of each work period, all Government facilities will be secured. The Contractor will establish and implement methods of ensuring that all keys issued to the Contractor by the Government are not lost, stolen, or misplaced, and are not used by unauthorized persons. The Contractor will not duplicate any keys issued by the Government. The Contractor will immediately report all occurrences of lost, stolen, or duplicated keys to the Contracting Officer. The Contractor will prohibit the use of keys issued by the Government by any persons other than the Contractor's employees and the opening of locked areas by Contractor employees to permit entrance of persons other than Contractor employees engaged in performance of contract work requirements in those areas. In the event that the Contractor needs additional keys, the Contractor will notify the Contracting Officer, in writing, of the additional key requirements and the Contracting Officer will make necessary arrangements for additional keys, if available.

4. OPTION TO EXTEND SERVICES. The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 calendar days.

5. OPTION TO EXTEND THE TERM OF THE CONTRACT. The Government may extend the term of this contract by written notice to the Contractor within 30 calendar days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 calendar days before the contract expires. The preliminary notice does not commit the Government to an extension. If the Government exercises this option, the extended contract shall be considered to include this option clause. The total duration of this contract, including the exercise of any options under this clause, shall not exceed 5 years, 6 months.
