Judicial Watch: Benghazi Documents Point to White House on Misleading Talking Points

(Washington, DC) – Judicial Watch announced today that on April 18, 2014, it obtained 41 new Benghazi-related State Department documents. They include a newly declassified email showing then-White House Deputy Strategic Communications Adviser Ben Rhodes and other Obama administration public relations officials attempting to orchestrate a campaign to “reinforce” President Obama and to portray the Benghazi consulate terrorist attack as being “rooted in an Internet video, and not a failure of policy.”  Other documents show that State Department officials initially described the incident as an “attack” and a possible kidnap attempt.
The documents were released Friday as result of a June 21, 2013, Freedom of Information Act (FOIA) lawsuit filed against the Department of State (Judicial Watch v. U.S. Department of State (No. 1:13-cv-00951)) to gain access to documents about the controversial talking points used by then-UN Ambassador Susan Rice for a series of appearances on television Sunday news programs on September 16, 2012.  Judicial Watch had been seeking these documents since October 18, 2012.
The Rhodes email was sent on sent on Friday, September 14, 2012, at 8:09 p.m. with the subject line:  “RE: PREP CALL with Susan, Saturday at 4:00 pm ET.”  The documents show that the “prep” was for Amb. Rice’s Sunday news show appearances to discuss the Benghazi attack.
The document lists as a “Goal”: “To underscore that these protests are rooted in and Internet video, and not a broader failure or policy.”
Rhodes returns to the “Internet video” scenario later in the email, the first point in a section labeled “Top-lines”:

[W]e’ve made our views on this video crystal clear. The United States government had nothing to do with it. We reject its message and its contents. We find it disgusting and reprehensible. But there is absolutely no justification at all for responding to this movie with violence. And we are working to make sure that people around the globe hear that message.

Among the top administration PR personnel who received the Rhodes memo were White House Press Secretary Jay Carney, Deputy Press Secretary Joshua Earnest, then-White House Communications Director Dan Pfeiffer, then-White House Deputy Communications Director Jennifer Palmieri, then-National Security Council Director of Communications Erin Pelton, Special Assistant to the Press Secretary Howli Ledbetter, and then-White House Senior Advisor and political strategist David Plouffe.
The Rhodes communications strategy email also instructs recipients to portray Obama as “steady and statesmanlike” throughout the crisis. Another of the “Goals” of the PR offensive, Rhodes says, is “[T]o reinforce the President and Administration’s strength and steadiness in dealing with difficult challenges.” He later includes as a PR “Top-line” talking point:

I think that people have come to trust that President Obama provides leadership that is steady and statesmanlike. There are always going to be challenges that emerge around the world, and time and again, he has shown that we can meet them.

The documents Judicial Watch obtained also include a September 12, 2012, email from former DeputySpokesman at U.S. Mission to the United Nations Payton Knopf to Susan Rice, noting that at a press briefing earlier that day, State Department spokesperson Victoria Nuland explicitly stated that the attack on the consulate had been well planned.  The email sent by Knopf to Rice at 5:42 pm said:

Responding to a question about whether it was an organized terror attack, Toria said that she couldn’t speak to the identity of the perpetrators but that it was clearly a complex attack.

In the days following the Knopf email, Rice appeared on ABC, CBS, NBC, Fox News and CNN still claiming the assaults occurred “spontaneously” in response to the “hateful video.” On Sunday, September 16 Rice told CBS’s “Face the Nation:”

But based on the best information we have to date, what our assessment is as of the present is in fact what began spontaneously in Benghazi as a reaction to what had transpired some hours earlier in Cairo where, of course, as you know, there was a violent protest outside of our embassy–sparked by this hateful video.

The Judicial Watch documents confirm that CIA talking points, that were prepared for Congress and may have been used by Rice on “Face the Nation” and four additional Sunday talk shows on September 16, had been heavily edited by then-CIA deputy director Mike Morell. According to one email:

The first draft apparently seemed unsuitable….because they seemed to encourage the reader to infer incorrectly that the CIA had warned about a specific attack on our embassy.  On the SVTS, Morell noted that these points were not good and he had taken a heavy hand to editing them. He noted that he would be happy to work with [then deputy chief of staff to Hillary Clinton]] Jake Sullivan and Rhodes to develop appropriate talking points.

The documents obtained by Judicial Watch also contain numerous emails sent during the assault on the Benghazi diplomatic facility.  The contemporaneous and dramatic emails describe the assault as an “attack”:

• September 11, 2012, 6:41 PM – Senior Advisor Eric Pelofsky, to Susan Rice:

As reported, the Benghazi compound came under attack and it took a bit of time for the ‘Annex’ colleagues and Libyan February 17 brigade to secure it. One of our colleagues was killed – IMO Sean Smith. Amb Chris Stevens, who was visiting Benghazi this week is missing.  U.S. and Libyan colleagues are looking for him…

At 8:51 pm, Pelofsky tells Rice and others that “Post received a call from a person using an [sic] RSO phone that Chris was given saying the caller was with a person matching Chris’s description at a hospital and that he was alive and well.  Of course, if the he were alive and well, one could ask why he didn’t make the call himself.”
Later that evening, Pelofsky emailed Rice that he was “very, very worried.  In particular that he [Stevens] is either dead or this was a concerted effort to kidnap him.”  Rice replied, “God forbid.”

• September 11, 2012, 4:49 PM – State Department press officer John Fogarty reporting on “Libya update from Beth Jones”:

Beth Jones [Acting Assistant Secretary, Bureau of Near Eastern Affairs] just spoke with DCM Tripoli Greg Hicks, who advised a Libyan militia (we now know this is the 17^th Feb brigade, as requested by Emb office) is responding to the attackon the diplomatic mission in Benghazi.”

Material is blacked out (or redacted) in many emails.
“Now we know the Obama White House’s chief concern about the Benghazi attack was making sure that President Obama looked good,” said Judicial Watch President Tom Fitton. “And these documents undermine the Obama administration’s narrative that it thought the Benghazi attack had something to do with protests or an Internet video.  Given the explosive material in these documents, it is no surprise that we had to go to federal court to pry them loose from the Obama State Department.”

  it doesn’t or shouldn’t cost 100′s of millions to get to an answer – dump the email servers, pull the handwritten notes and playback the tapes. Spend a few weeks reconstructing the timeline and you will have your answers. But I think you will find that the video excuse came first from the State Department and came very early in the assault. It was clear that the video excuse was teed up as part of what happened in Cairo and getting information is going to take the courts to pry loose from the players involved

  I have not read all 112 pages. I think I’m around page 50. And what I had seen so far indicated there was no ‘smoking gun’. And you’re right. A politician worth his/her salt wouldn’t leave one to be found. But history has shown us a lot of them were not worth their salt.

  I have read all 112 pages – there is only one real good smoking gun (Rhodes email) but many many many dots that easily connect and show the momentum around the cover up as it took hold. For your reading pleasure I will cite my analysis. I am glad to have your rebutle but I doubt you do:
  There is more there than just a few emails when you pull the raw FOIA response. The redactions are heavy, and they start on the 14th and not the 11th or 12th which is important and I am sure in due time we will get those early ones too. Here you go – and you have to start with the premise, as I believe, that the Cairo action was not inspired by the video. It was the start of a bad chain of events related to militant Islam, the failure of our policy in Egypt the “holy day” for militants (9/11) and the fact that since Cairo wasn’t a rock throwing “skirmish” it DIDNT fit the campaign narrative of “decimated and on the run”
  Now go from breaching the walls and raising a black flag (Cairo) on the news (daylight) for the entire world to see and leap to a murdered ambassador and you MUST have a scapegoat, otherwise it’s your problem as POTUS.

(My comment now – how do you get something with that narrative and completely turn it around because that first narrative was deemed “not good”? Not good is an easy description for an unflattering truth, if it was untrue or simply not accurate or had no basis in fact, those are the words that should have appeared. CLearly there is something “here”
  Red flag number 3 recon email. Saturday the talking points are not yet “ready” and they are coming from the state department (jake works for Hillary but has since been promoted to work for Biden). Why aren’t they coming from the military or CIA? It is clear this is no longer a truth or fact finding exercise, all spin based on the junior staffers involved on Saturday
  Red flag number 4 Morell email at 11:08 am Saturday – he has boiled it down to 3 talking points. He knows at this time (4 days later) that is was not a spontaneous protest (paneta testimony is clear it was known and discussed much earlier than the 4th day)
  Red flag number 5 all the redacted emails in response to foxes news story on September 27th that year knew within 24 hours. The funny thing is the redacted reason codes are B5 (client attorney privilege / deliberative process) or B6 (mostly B6) which is PERSONAL PRIVACY INFORMATION. It has nothing to do with national security. If fox is so wrong, why the pages and pages of redacted emails? If there is nothing to hide, why hide it. I will assume B6, that this is embarrassing stuff because now its used for entire paragraphs, previously? Only to hide email addresses. Kind of strange huh?

We know its a LIE and it was never misinformation created in real time as events occurred. There were no witness statements within the first two hours. This itself may have been a simple “connect it to Cairo” because we need how to explain CAIRO and this video is a damn good excuse.
  Red flag number 7 Eric pedrofsky email one hour later – believes Sean smith is dead, Stevens is missing and that it took the CIA (annex colleagues) a bit of time to secure it.
  Red flag number 8 – Clinton statement on video as cause. Before then annex is attacked she takes to the air to deplore the video. No knowledge of this what so ever but it the official storyline for Cairo and at this point she has made it clear it is the story line for this event.
  Red flag number 9 Alex mcphillips email to Susan rice at 6:17 pm est highlighting a CNN reporter on the ground stating ansar al sharia as the aggressor. They are a known al Qaeda affiliated terrorist group.
  Red flag number 10. Susan rice and her colleagues do not know by 6 am the next morning who was killed or injured. By this time everyone had been evacuated for several hours. All 4 bodies had been retrieved and were already out of Libya by then according to the official timeline. Or maybe they weren’t. I will chalk it up to a delay though why she should wait several hours to be told is beyond me
  Red flag number 11 the narrative from Payton on the morning of the 12th. This is important. She makes comments that definitely get dialed back in the coming days and it is very very detailed. The word extremists are used, the video is never mentioned. She is told it was a COMPLEX attack. They KNEW. On the morning of the 12th Obama is asked about the actual group claiming the attack, it’s obvious it’s not a spontaneous mob at this point, but mo one runs with it (liberal media)
  Red flag number 12 Alex mcphillips email of the 12th recounting to Susan rice tweets fromlibya about the “terrorists”.
  Red flag number 13 Alex mcphillips email on the 13th outlining the French press story that US officials believe it was terrorism related to the September 11th anniversary (Susan rice now KNOWS this is not possible but probable)
  Red flag number 14 – reading the Sunday transcripts. The hosts all knew this wasn’t spontaneous but she stuck with the narrative. She simply should have said, its possible, but we don’t know. Sticking to the conspiracy to spin this favorably for the president and Hillary is the cover up.
  There is no SMOKING GUN – politicians are generally too smart for that, plus they have way too much privilege to redact. But there is clearly a pattern to deny the experts and evidence and to spin this for political purposes. Clear as day. I hope the non redacted material under subpoena is even clearer. But I will tell you this, I think the calculus in this is Hillary, she drives the video story.

  The video had been online for months and we know now that the NSA intercepted a call from the attackers after the fight to al Qaeda leadership and we know from witnesses THAT NIGHT that there were NO protests. In fact CNN tweeted during the first two hours on the ground as a witness that it was not a protest. The French press maintained from day 1 the same thing. It is easy to understand why the presidents people did what they did. He certainly would have lost the election if it were understood that the terrorists were not defeated and on the run. My understanding is that he was informed of the attack early on, but never made contact with the situtation room for the rest of the night. An American abassador was missing and several of his people were dead on the ground yet he simply went to bed then to a fund raiser in the morning. Do you find that acceptable? In the same situation is this what you would have done?
  I have noticed the much of this discourse ends up in arguments over tiny details or the meaning of certain words. We often lose sight of the bigger picture.   My only true concern about this is that most people whole-heartedly believe that their party can do no wrong. Their whole reason for existing is to divide people into two factions. Fox News praises Republican while destroying Democrats, and MSNBC praises Democrats while destroying Republicans. Yet most people accept whatever their “team” needs to do in order to win.   THE PRESIDENT: Good morning. Every day, all across the world, American diplomats and civilians work tirelessly to advance the interests and values of our nation. Often, they are away from their families. Sometimes, they brave great danger.
  Yesterday, four of these extraordinary Americans were killed in an attack on our diplomatic post in Benghazi. Among those killed was our Ambassador, Chris Stevens, as well as Foreign Service Officer Sean Smith. We are still notifying the families of the others who were killed. And today, the American people stand united in holding the families of the four Americans in our thoughts and in our prayers.
  The United States condemns in the strongest terms this outrageous and shocking attack. We’re working with the government of Libya to secure our diplomats. I’ve also directed my administration to increase our security at diplomatic posts around the world. And make no mistake, we will work with the Libyan government to bring to justice the killers who attacked our people.
  Since our founding, the United States has been a nation that respects all faiths. We reject all efforts to denigrate the religious beliefs of others. But there is absolutely no justification to this type of senseless violence. None. The world must stand together to unequivocally reject these brutal acts.
  Already, many Libyans have joined us in doing so, and this attack will not break the bonds between the United States and Libya. Libyan security personnel fought back against the attackers alongside Americans. Libyans helped some of our diplomats find safety, and they carried Ambassador Stevens’s body to the hospital, where we tragically learned that he had died.
  It’s especially tragic that Chris Stevens died in Benghazi because it is a city that he helped to save. At the height of the Libyan revolution, Chris led our diplomatic post in Benghazi. With characteristic skill, courage, and resolve, he built partnerships with Libyan revolutionaries, and helped them as they planned to build a new Libya. When the Qaddafi regime came to an end, Chris was there to serve as our ambassador to the new Libya, and he worked tirelessly to support this young democracy, and I think both Secretary Clinton and I relied deeply on his knowledge of the situation on the ground there. He was a role model to all who worked with him and to the young diplomats who aspire to walk in his footsteps.
  Along with his colleagues, Chris died in a country that is still striving to emerge from the recent experience of war. Today, the loss of these four Americans is fresh, but our memories of them linger on. I have no doubt that their legacy will live on through the work that they did far from our shores and in the hearts of those who love them back home.
  Of course, yesterday was already a painful day for our nation as we marked the solemn memory of the 9/11 attacks. We mourned with the families who were lost on that day. I visited the graves of troops who made the ultimate sacrifice in Iraq and Afghanistan at the hallowed grounds of Arlington Cemetery, and had the opportunity to say thank you and visit some of our wounded warriors at Walter Reed. And then last night, we learned the news of this attack in Benghazi.
  As Americans, let us never, ever forget that our freedom is only sustained because there are people who are willing to fight for it, to stand up for it, and in some cases, lay down their lives for it. Our country is only as strong as the character of our people and the service of those both civilian and military who represent us around the globe.
  No acts of terror will ever shake the resolve of this great nation, alter that character, or eclipse the light of the values that we stand for. Today we mourn four more Americans who represent the very best of the United States of America. We will not waver in our commitment to see that justice is done for this terrible act. And make no mistake, justice will be done.
  But we also know that the lives these Americans led stand in stark contrast to those of their attackers. These four Americans stood up for freedom and human dignity. They should give every American great pride in the country that they served, and the hope that our flag represents to people around the globe who also yearn to live in freedom and with dignity.
  We grieve with their families, but let us carry on their memory, and let us continue their work of seeking a stronger America and a better world for all of our children.
  Thank you. May God bless the memory of those we lost and may God bless the United States of America.
