Supreme Court to Review Obama’s Citizenship

Okay, before all the “birthers” out there begin saying, “I told you so, KTracy!”, let’s establish the situation.
First, for those of you who either don’t believe me or who love reading about Supreme Court cases (regardless, there’s something wrong with you), we are talking about Docket Number 12a606.  Chief Justice Roberts agreed to have the case reviewed after Justice Kennedy, a Reagan appointee, rejected it.  At face value, the case appears to only be about fraudulent voting in California.  However, 12a606 goes far beyond that, challenging the very eligibility of Barack Obama on the 2008 Presidential Ticket.
It’s imperative that everyone understands that just because the Supreme Court has chosen to review a case doesn’t mean they will hear a case.  Every year, the Supreme Court reviews around 10,000 cases and only hears 100 of them.  In other words, the conspiracy that Obama’s citizenship is forged only has a 1% chance of being heard.
What needs to happen for the case to be heard?
The Supreme Court Justices will review all of the evidence in the case in order to determine its legitimacy and importance that it needs to be heard by US Supreme Court.  After reviewing the case, at least four Justices have to vote in favor of hearing the case.  And that’s about it.  Again, only about 1% of the cases actually get heard, so it’s a lot more difficult than it seems.

There are a few things that might lead the Supreme Court to choose to hear a case against Obama’s citizenship.
The foremost, is timing.  Docket Number 12a606 is actually a challenge to the 2008 election.  Had the Supreme Court reviewed a case about Obama’s citizenship prior to President Obama taking the oath of office in 2013, deciding to hear this case would have made the Democrat’s 2008 Presidential Ticket ILLEGITIMATE.  This then would have immediately promoted John McCain to the Presidency.  The consequences of such a decision could have so severely damaged our Republic that none of the Justices wanted to instigate such an act.  However, because the 2012 election is not being contested, a successful challenge to Obama’s 2008 election would result in Obama no longer being qualified to serve as President, making Vice President Joseph Biden the new President.  Certainly, the decision now would have far fewer consequences.

Another factor to consider is that the justices of the Supreme Court really hate Barack Obama.  President Obama has time and again made them a scapegoat for most of his progressive policy failures.  The Supreme Court repeal of certain campaign finance reform laws drew the most fire from the President and his men; which ultimately led to three of the Supreme Court Justices (Antonin Scalia, Clarence Thomas, and Samuel Alito) skipping the 2011 State of the Union.  Keeping in mind that it was Chief Justice Roberts that has chosen to review the case, let’s do some math!

Do you remember what I said happens when there are 4 Supreme Court Justices on the same page in the review process?  That’s right, a case gets heard and math suddenly becomes a lot more fun.
There’s another fact we need to consider.  This question of Obama’s citizenship is always going to be hanging around this President and his legacy.  Even if the grassroots “birthers” are kind of crazy and scary sometimes, the conspiracy theory will always be around.  If the Supreme Court doesn’t hear the case, it risks tarnishing the reputation of the Supreme Court.  This reputation is VERY important to the survival of the Supreme Court.  If Obama’s citizenship remains an unheard matter, historians will question the necessity of the Supreme Court if they’re not going to hear cases that directly impact the United States Constitution and our government.  This probably isn’t what a birther wants to hear, but if this is the Supreme Court’s reasoning for hearing the case, they are probably hearing the case simply so they can shoot it down unanimously and put an end to these rumors and conspiracy theories about Obama’s citizenship.

The other side of the dignity of the Supreme Court argument I just made for why they would hear the case is that they WON’T hear the case because they believe hearing such a ridiculous case would actually be demeaning to the court.  Historians can just as equally ask, “What’s the point of the Supreme Court if they hear foolish cases like these but won’t hear more important cases about matters of the treatment of detained terrorists and the potential mass-murder-for-profit of millions of American children; especially because new evidence has surfaced proving that life begins at conception since Roe v. Wade in 1973 (40 years ago!).
Let’s face it, many of the same people behind this birther nonsense are the same people behind the 9/11 “truther” nonsense.  The Supreme Court probably won’t want to lower itself to that level.
Another consideration is that any decision they make, for or against Obama’s citizenship, will be HIGHLY politicized.  Conservatives and Progressives are both holding grudges against the Supreme Court.  Conservatives for the Supreme Court not overturning a lot of aggressive progressive policies that they argue are destroying American culture and the intent of the Founding Fathers.  Progressives because they see the Supreme Court as having given the 2000 election to President George W. Bush, upheld the Arizona Immigration Reforms, and because the Supreme Court does occasionally overturn progressive policies from time to time because the programs reached for more than the Constitution allowed them.  The 2nd Amendment is a good example of this.  Whatever the Democrats manage to pass, the Supreme Court will overturn the majority of it.
Finally, the evidence might be as coherent as a Ron Pauler’s explanation of why they believe deodorant is poisoning them.  By reviewing the case but deciding not to hear it, they make the same statement as having heard the case without all the controversy.  The Supreme Court would be saying,  ”We looked at it, but it was ridiculous.”  And it really is ridiculous.    The conspiracy about Obama’s Citizenship is a million times more complex than the 9/11 conspiracies.  We’re talking about Obama’s people infiltrating the State Department, FBI, INS, the Social Security Office, and more; then changing, pulling, or otherwise manipulating records in ways that nobody would notice; and finally making sure that nobody ever spoke of what they did.

As much as I would LOVE to see the relatively more moderate Joe Biden take the Oval Office and replace Barack Obama, my desire to see Obama stopped isn’t strong enough to make me delusional.  Obama’s citizenship really isn’t a matter of debate for me.  I have yet to see anything that makes me truly question Obama’s citizenship.
Obama’s policies, ideology, and understanding of the economy are regularly questioned on this end of KTracy.com… but not Obama’s Citizenship.
