Congressman Stockman: Not Even Boehner Can Stop Lois Lerner’s Arrest

On Thursday, Congressman Steve Stockman announced that he and several colleagues filed an official resolution calling for the House Sergeant-at-Arms to arrest Lois Lerner, a key figure in the Obama IRS targeting scandal, for contempt of Congress (WATCH INTERVIEW BELOW).

Congressman Stockman said in his announcement on Thursday that “Asking the Justice Department to prosecute Lois Lerner for admittedly illegal activity is a joke.”

In May, Republican Speaker of the House John Boehner admitted to FOX Business’s  Maria Bartiromo that Congress did have the constitutional power and authority to arrest Lerner, but was waiting for Obama Attorney General Eric Holder, the first sitting AG in history to be held in contempt of Congress, to “do his job.” When asked whether Lerner should be arrested, Boehner said, “Uh…I’m not the historian here. But it’s never been used and I’m not sure that it’s uh, uh, an appropriate way to go about this. It’s up to Eric Holder to do his job.”

On Thursday, Megyn Kelly interviewed Rep. Stockman on her FOX News program, “The Kelly File,” asking about the push to arrest Lerner, who admitted in May of 2013 that the Obama IRS targeted  Tea Party and other political opponents of Obama, a direct assault to their First Amendment rights.

Congress looks inept when we don’t carry through,” Stockman told Kelly, referring to Congress’s lack of action following Lerner’s being held in contempt. “We issued a contempt order against her, and we need to act upon it,” he asserted.

“This is a privileged motion. This is something even [Republican Speaker of the House] John Boehner, if our understanding is correct–he can’t even stop,” Rep. Stockman told Kelly, while continuing on to explain that the resolution to have the Sergeant-at-Arms arrest Lerner could pass with a simple majority vote.

“The Senate or the president can’t veto it or interfere, and under the orders of the House, she would be arrested and brought to a jail. She has to respond,” Stockman said, explaining Lerner’s long history of persecuting conservatives, going back to her time working at the FEC.
