FL Bar Opposes HB351

Earlier this month, we asked you to contact legislators to prevent the Anti-Religious Freedom bills from passing. Florida State Senators Alan Hays and Greg Evers sponsored SB 58: Application of Foreign Law in Certain Cases. Florida Representative Larry Metz sponsored the companion HB 351.

You were not alone in opposing these bills. The Florida Bar's International Law Section released its official stance in opposition of HB 351 and SB 58:

Senate Bill 58 and House Bill 351 are the latest iterations of proposed legislation that, for the past three years, has been introduced to address a perceived problem that in fact does not exist -- "to protect American citizens' constitutional rights against the infiltration and incursion of foreign laws and foreign legal doctrines, especially Islamic Shariah Law."

In fact, SB 58 and HB 351, the newest anti-Sharia bills, offend Florida's separation of powers and public policy. We didn't say that, the International Law Section did: 

SB and HB 351 prohibit trial court judges from applying foreign laws, or in some cases, even religious laws, in divorce or child custody proceedings unless the foreign law/religious law is the "same" as Florida law... the ILS opposes these bills.
