Frequently asked questions Am I a Plaintiff in a lawsuit now? A class action is a special form of lawsuit, where a group of individuals agree to represent the interests of everyone who was arrested in securing relief. These persons, who must be arrestees themselves, have started with an initial group of five named plaintiffs and will expand. These persons, the named plaintiff class representatives, agree to make the commitment to go through the procedures, the discovery, the depositions, court hearings, etc. in order to secure benefit for the entire group as a whole. The vast majority of the arrestees, who are not class representatives, are often called "absent class members." Their interests are advanced by the class representatives, and the absent class members can secure money and other relief through a favorable class action resolution. There is no cost to plaintiffs and absent class members (upon a certification) to participate in this case. The Partnership for Civil Justice Fund has agreed to bear the costs of expenses of the litigation during the pendency of the case. At this time, a class action complaint has been filed. Later, a motion for class certification will be filed in which the Partnership for Civil Justice Fund will present the Court with information to establish that the facts of this case are suitable for class action treatment, and other information. After formal certification as a class action, a Court orders formal notice be issued to all arrestees (i.e., absent class members) describing rights and obligations and the process as the Court determines it shall proceed, as well as options as to making decisions about being part of the case. If I provide my contact information to you now, is that all I have to do to be a part of any settlement or judgment? No. Providing us with your contact information enables us to attempt to reach you by e-mail with updates and information, solely as a courtesy. It does not mean that you are "registered" to receive funds if any are recovered through trial or settlement in the class action. There is, of course, no guaranteed outcome to this case. In a class action, the procedures and processes are authorized by the Presiding Judge in accordance with established rules. There may be a formal application, a "Proof of Claim" form that would need to be submitted in order to receive any proceeds or benefits from a class action resolution. As above, if a class is certified, the Court will cause formal notices to be issued that will describe rights, options and procedures. We will also place copies of any formal notices on our web site, which you are encouraged to visit periodically. What paperwork do I need to save? Any papers that reflect or relate to your arrest, or which evidence or "prove" that you were, in fact, part of the mass false arrest on October 1, 2011, should be preserved. Any papers provided to you upon release, any desk appearance tickets (DAT), any documentation that establishes or tends to show that you were in fact were arrested should be preserved. Ideally, make a copy and maintain in separate locations. Do not send paperwork to us. Are you attorneys for the class? At this time, the PCJF attorneys are attorneys for the named plaintiffs and have filed a class action complaint seeking to vindicate the interests of all those who were arrested. We will, in the ordinary course of proceedings, file a motion to certify the class which, if approved by the Court, would result in our appointment as Class Counsel representing all those who proceed as class members.
